Tiers inconnu, pression, menace, tarifs élevés, etc

  • Dear Manager,

(If you are not the person who is in charge of this, please forward this to your CEO,Thanks)

We are a organization specializing in trademark consulting and domain name registration services in China. We just received an application sent from "HaiTon Importing Co., Ltd" on 27/07/2014, requesting for applying the "wheelsofitaly" as the Internet Brand and some Chinese domains such as .cn/.com.cn/.hk/.asia ect... for their business running. Though our preliminary review and verification, we found that this keyword is currently being used by your company and is applied as your domain name. In order to avoid any potential risks in terms of trademark dispute and impact on your market businesses in China and Asia in future, we need to confirm with you whether "HaiTon Importing Co., Ltd" is your own subsidiary or partner.

Will your businesses in China and Asia be impacted potentially if they apply for this trademark? And will you agree this company to apply for this trademark? Please contact us immediately within 10 working days, otherwise, you will be deemed as waived by default.

  • Dear Maria,

Thanks for your reply. What Candy Industries Ltd is eager to apply for registering are the following available domain names.
    [VOTRE DOMAINE DE SECOND NIVEAU].cn
    [VOTRE DOMAINE DE SECOND NIVEAU].asia
    [VOTRE DOMAINE DE SECOND NIVEAU].hk
    [VOTRE DOMAINE DE SECOND NIVEAU].com.hk
    [VOTRE DOMAINE DE SECOND NIVEAU].tw
    [VOTRE DOMAINE DE SECOND NIVEAU].jp

If you did not consign Candy Industries Ltd to register them, according to my work experience, there may be 2 possibilities.
    1. That company is a domain investor, they want to register these names before you and sell them back to you to gain profits;
    2. It may be a commercial method, that company is consigned by your competitor to register these domains and confuse your clients.

Because domain takes open registration, this is inter.ional domain registration principle, they have the right to register these available domains. As a domain name registrar, we have no right to reject their application. So required by our government to inform your company to protect your interest.

As the owner of "[VOTRE DOMAINE DE SECOND NIVEAU].com",you will get the priority to register these domains. If you think they are important and intend to register these domains,we can send you the application form, registration price and procedures to help you complete the registration within dispute period, this is the only way to prevent domain name from being grabbed. But if you don't think their application will do harm to your profits, you can give up.

Please give me your decision ASAP so that we can conduct the next step work.

    Best Regards,
    Henry Luo

    Dear Sir/Madam,

Thanks for your confirmation. As soon as receiving the application of "CrlTeny Company"/"CanLduny Company"/"NorKery Company", we checked and found "[VOTRE DOMAINE DE SECOND NIVEAU]" is your company's using name and brand. We are concerned that your brand name might be affected negatively by their applications, this is why we informed you. following Network Brand and domain names are applied by "CrlTeny Company"/"CanLduny Company"/"NorKery Company":
Net Brand: [VOTRE DOMAINE DE SECOND NIVEAU]
    Domain Names:
    "[VOTRE DOMAINE DE SECOND NIVEAU].asia
    [VOTRE DOMAINE DE SECOND NIVEAU].cn

    [VOTRE DOMAINE DE SECOND NIVEAU].中国
    [VOTRE DOMAINE DE SECOND NIVEAU].com.hk
    [VOTRE DOMAINE DE SECOND NIVEAU].hk"
You know that the domain names registration is open in the world, "CrlTeny Company"/"CanLduny Company"/"NorKery Company" also has the right to apply for the available domain names. you only have the preferential rights to register them.
We also are not very clear about why the company wants to register these domain names, but according to our work experience, either they just invest these domain names.
Just like a company named Beijing national network information LLC registered google.cn & google.com.cn in 2005, and then they made lots of return from these two domain names. (Google Company failed to make a arbitration and paid 1 million USD dollars to redeem the two domain names.) Or they are just your trade, and confuse your clients to make profit.

At present, we haven't passed their application, we need your opinion. If your company consider these names of importance to your company's business or interest, I suggest that your company register these names first so as to avoid confusion or speculation. Of course, If you don't want to protect your intellectual property rights, then my suggestion is your company give up these names so that we can finish registering for them as per our duty. Please give me your company's decision as soon as possible in order to handle this issue better.
    Have a nice day.

How are you! The reason why I am sending you this email is because we received an application from "SYT Industry Ltd" today who wants to register the brand name:"keepalert" and some relevant domains under "keepalert" in different areas.
Due to the applicant's name "SYT Industry Ltd" is quite different from "[VOTRE DOMAINE DE SECOND NIVEAU]", so we checked in system and found "[VOTRE DOMAINE DE SECOND NIVEAU]" is your using name. In accordance with domain registration principle, we are obliged to inform you this case. Please confirm whether "SYT Industry Ltd" was authorized by you. If not, please contact me within 7 workdays for letting us handle this case properly. Out of the period, we would regard this application was authorized by you and accept their application legally. • Dear [VOTRE NOM]:

    Thanks for email.
Based on your company having no relationship with them, we have suggested they should choose another name to avoid this conflict but they insist on this name as CN/Asia domain names (.asia/.cn/.com.cn) and internet keyword on the internet. In our opinion, maybe they do the similar business as your company and register it to promote his company. You must know Domain name takes open registration, this is international domain name registration principle. Any companies or individuals have rights to register any domain name and internet keyword which are unregistered. Because your company haven't registered this name as CN/ASIA domains and internet keyword on the internet, anyone can obtain them by registration. As a domain name registrar, we have no right to dispute their application. However, in order to avoid this conflict, as the owner of the name or trademark, your company will get the priority to make this registration in our audit period. If you think these domain names are useful for your company application form and the price list to you and help you register these CN/ASIA domain names (.asia/.cn/.com.cn/) and internet keyword within dispute period. If not, you can give up and we will finish their registration.

    Kind regards.

    Jim/Abby Wang

    Dear CEO,

Based on your company having no relationship with them, we have suggested they should choose another name to avoid this conflict but they insist on this name as CN/ASIA domain names ( [VOTRE DOMAINE DE SECOND NIVEAU].asia , [VOTRE DOMAINE DE SECOND NIVEAU].cn, [VOTRE DOMAINE DE SECOND NIVEAU].com.cn, [VOTRE DOMAINE DE SECOND NIVEAU].net.cn, [VOTRE DOMAINE DE SECOND NIVEAU].org.cn) and internet keyword ([VOTRE DOMAINE DE SECOND NIVEAU]) on the internet. In our opinion, maybe they do the similar business as your company and register it to promote his company.
According to the domain name registration principle: The domain names and internet keyword which applied based on the international principle are opened to companies as well as individuals. Any companies or individuals have rights to register any domain name and internet keyword which are unregistered.
Because your company haven't registered this name as CN/ASIA domains and internet keyword on the internet, anyone can obtain them by registration.
However, in order to avoid this conflict, the trademark or original name owner has priority to make this registration in our audit period. If your company is the original owner of this name and want to register these CN/ASIA domain names ([VOTRE DOMAINE DE SECOND NIVEAU].asia, [VOTRE DOMAINE DE SECOND NIVEAU].cn, [VOTRE DOMAINE DE SECOND NIVEAU].com.cn, [VOTRE DOMAINE DE SECOND NIVEAU].net.cn, [VOTRE DOMAINE DE SECOND NIVEAU].org.cn) and internet keyword ([VOTRE DOMAINE DE SECOND NIVEAU]) to prevent anybody from using them, please inform us. Dear [VOTRE NOM],

I appreciate your confirmation. When we received their application request, we checked those names and found they contains your company’s using name " [VOTRE DOMAINE DE SECOND NIVEAU] ". We assume it may bring negative influence on your company’s business once they succeed in registration so we inform you of this situation.

The brand name and domain names they are applying to register are as follows:
    Brand Name:
    [VOTRE DOMAINE DE SECOND NIVEAU]
    Domain Name:
    [VOTRE DOMAINE DE SECOND NIVEAU].cn
    [VOTRE DOMAINE DE SECOND NIVEAU].com.cn

The registration principle is “First register, First obtain”, any entity or individual has rights to register available names. However, I want to remind you that you have the preferential rights to register them since you are the owner of the brand or first user of this domain name.

Right now, we don’t accept their application request, we need your decision. If you think those names are important to your business development, we suggest you register them; if you don’t think their application will affect your business in the future, you can give them up and we will accept their registration request and finish registration for them.
Please give me your company’s decision ASAP. Further questions, feel free to contact me anytime.

    Dear [VOTRE NOM],
Based on your company having no affiliation with them, we have suggested they should choose another name to avoid this conflict but they insist on this name as China domain names (.asia/.cn/.com.cn/.hk/.tw/.com.tw) and the Network Brand. In our opinion, maybe they do the similar business as your company and register it to promote his company.
According to the domain name registration principle: The domain name and Network Brand which applied based on the international principle are opened to companies as well as individuals. Any companies or individuals have rights to register any domain name and Network Brand which are unregistered. Because your company haven’t registered this name as China domains and Network Brand on the internet, anyone can obtain them by registration. However, in order to avoid this conflict, the original name owner has priority in the registration of China domain name and Network Brand during our audit period. If your company is the original owner of this name and want to register these China domain names (.asia/.cn/.com.cn/.hk/.tw) and Network Brand to prevent anybody from using them, please inform us. We can send you an application form with price list to help your company register these China domains and Network Brand during our audit period.

    Dear [VOTRE NOM],
The checking time will be over soon, we have not received your reply about the domain name and trademark since our last communication. You must know domain name takes open registration, this is international domain name registration principle. So the company has right to register them. As a domain name registrar, we have no right to refuse their application. We aslo suggest this company should change another name but they stick to this name so if your company want to prevent anybody from using these domains, the only way is to register these domains and trademark. In our checking time, your company has first priority to register them. Could you tell us whether your company want to make this application to prevent anybody from using them or not?

  • Dear [VOTRE NOM],

Based on your company having no relationship with them, we have already advised them to choose another name, but they insist on this name as China domain names ( [VOTRE DOMAINE DE SECOND NIVEAU].cn/ [VOTRE DOMAINE DE SECOND NIVEAU].com.cn/ [VOTRE DOMAINE DE SECOND NIVEAU].net.cn/ [VOTRE DOMAINE DE SECOND NIVEAU].org.cn) and internet keyword. In our opinion, maybe they do the similar business as your company then register it to promote his company.

As is known to all, domain name registration based on the international principle is opened to company and individual. Any company or individual have the right to register any domain name and internet keyword which are unregistered. Your company haven't registered this name as China domains and internet keyword, so anyone is able to obtain them by registration. But in order to avoid this conflict, the trademark or original name owner have priority to register China domain name and internet keyword during our review period. If your company is the original owner of this name and wants to register these China domain names ( [VOTRE DOMAINE DE SECOND NIVEAU].cn/ [VOTRE DOMAINE DE SECOND NIVEAU].com.cn/ [VOTRE DOMAINE DE SECOND NIVEAU].net.cn/ [VOTRE DOMAINE DE SECOND NIVEAU].org.cn) and internet keyword to prevent anybody from using them, we can send you an application form with price list to help your company register these China domains and internet keyword during our review period.

    https://authorize-certification.net/show.asp?Domain=xxxx

Do you want to accept this bid and start the sale process or you prefer to wait for higher offers?

Our company relies on the integrity of the users of its services to honor their commitments. If the buyer makes an offer to purchase the rights to a domain name, and the offer is accepted, both the buyer and the seller are obligated to complete the transaction. You cannot place or accept an offer that is manipulative, such as placing an offer that you know you do not have at your disposal sufficient resources to cover.

    Classic Escrow Process:

    1. Seller accepts a bid from buyer.

    2. Buyer submits payment to us by check (5-7 days for express delivery).

    3. You pay 1.5% bank fee to clear the check. We clear the check in 4-6 days.

    4. We release 50% to Seller and he transfers domain to buyer.

    5. We release the other 50% to Seller.

If you need a much faster transaction which will cost you $0 please use Crypto Escrow Process:

    3. Buyer sends funds to ETH wallet of escrow. We verify payment via blockchain network.

    4. We release 50% to Seller and he transfers domain to buyer.

    5. We release the other 50% to Seller.

    6. After we confirm domain transfer via WHO IS we send 15 ETH deposits back
    to Buyer and Seller.

Advantages: No need to wait for several weeks for check's delivery. Your deposit is returned to you so the total price is $0.

Please let us know which escrow you want to use: Classic or Crypto Escrow?
